Generally, an impaired or 'over 80' charge and 90 day automatic driver's licence suspension (ADLS) does not constitute just cause for dismissal.  Even if your job is driving a fuel tanker and you are later convicted of the offence.  Just ask my client Mr. Reininger who sued his employer for wrongful dismissal and won.  See Reininger v Unique Personnel, Ontario Superior Court of Justice at Peterborough (Howden, J.)
